TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL phdiba, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE SERVICE.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, phdiba's liability shall be limited to the maximum extent permitted by law. In no event shall phdiba's total liability to you for all damages exceed the amount you deposited in your account during the twelve (12) months preceding the claim.

10. Dispute Resolution and Governing Law

These Terms and any disputes arising out of or related to your use of the phdiba platform shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any disputes that cannot be resolved through customer support shall be subject to the exclusive jurisdiction of the courts located in Metro Manila, Philippines.

Most disputes can be resolved quickly and amicably through direct communication with our support team. If the dispute cannot be resolved within thirty (30) days, either party may proceed with formal legal action.

11. Account Suspension and Termination

phdiba reserves the right to suspend, restrict, or terminate your account at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, fraudulent activity, providing false information during registration, failure to complete verification procedures, chargebacks or payment disputes, or any activity that the Company deems harmful to the platform or other Users.

Upon termination of your account, your right to use the Service will immediately cease. If your account is terminated for violation of these Terms, you may forfeit any remaining balance, pending winnings, and bonus funds. phdiba will make reasonable efforts to return any legitimate funds in accounts terminated for non-violation reasons, subject to verification and withdrawal procedures.
